Welcome to Chasing Next by Moonswell Marketing LLC (“we”, “us”, or “our”). By accessing or using this platform, our interactive training materials, or any associated services, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, please do not use the platform or services.
1. Use of This Platform and Content
You may access and use our platform, training modules, and associated materials for personal or organizational use only. Redistribution, resale, or commercial use of any materials without express written permission is strictly prohibited.
Use of our materials or recommendations is at your discretion, and we are not responsible for how you apply them. All materials are provided “as-is” and “as-available” without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
2. Platform Access & Licensing
- Individual access is licensed to the individual user only.
- Team and organizational licenses must be arranged through our licensing program and may not be shared beyond the licensed group.
- Free-tier access is limited to select modules and does not include team features, manager dashboards, or organizational reporting.
- All content is protected by copyright and may not be reproduced or distributed without permission.
3. User Submissions
The platform includes interactive exercises where you submit work artifacts, responses, and files. You retain ownership of the content you submit. By submitting content, you grant us a limited license to store, display, and use your submissions for platform functionality (such as the team feed, manager dashboards, and completion tracking).
Community Feed. Submissions are shared to the community feed by default so that teammates and peers can see what others are building. You can opt out of sharing any individual submission at the time of submission. Submissions shared to the feed are visible to other users within your organization (for team accounts) or within the platform community (for individual accounts). You can update your sharing preference on any submission at any time.
Anonymized Use.We may use anonymized and aggregated submission data for product improvement, marketing, and case study materials. This includes describing the types of workflows, systems, and tools that learners build on the platform in general terms (e.g., “teams have created brief generators, reporting workflows, and review checklists”). We will not publicly attribute specific submissions or work artifacts to you, your team, or your organization without explicit written consent.
Ratings and Feedback.When you rate lessons or provide feedback, this data may be used in anonymized aggregate form (e.g., “average rating 4.6/5”) for product improvement, marketing, and case study materials. We may also use anonymized aggregate ratings and feedback in sales materials, on the website, and in proposals (e.g., “8.7 out of 10 NPS”). Individual feedback comments may be quoted anonymously with identifying details removed. Named testimonials, attributed case studies, or any use of your name, company, or likeness in marketing require your explicit written consent.
4. Intellectual Property
All platform content, training materials, module designs, and associated intellectual property are owned by Moonswell Marketing LLC. You retain full ownership of all work artifacts, workflows, and systems you create using the platform. Nothing in these Terms transfers ownership of your work product to us. The limited license granted in Section 3 is solely for platform functionality and does not constitute a transfer of ownership.
5. Payment & Refunds
- All purchases are processed securely via Stripe. We do not store your payment information.
- Team and enterprise licenses are non-refundable once access is granted, due to the customized setup and delivery process. Refunds or adjustments for licensed programs are considered only at our discretion.

6. Digital Purchases & Personalization
Certain features on the platform are available as individual digital purchases, including per-module personalization unlocks and access to paid modules. By completing a purchase, you acknowledge and agree to the following:
- All digital purchases are final. Because personalized content is generated based on your specific inputs and delivered immediately upon purchase, refunds are not available for personalization unlocks or paid module access. If you experience a technical issue preventing delivery, contact support and we will resolve it.
- Personalization unlocks are per-module and non-transferable. Each unlock applies to a single module for your account only. Unlocks cannot be transferred to other users or applied to other modules.
- Content may be updated over time. We may update, improve, or modify personalized and module content at any time. Purchased access remains valid through any updates.
- No guarantee of specific outcomes. Personalized content is generated based on the information you provide in your profile. The quality and relevance of personalized content depends on the detail and accuracy of your inputs. We do not guarantee specific results from using personalized or any other platform content.
- Pricing may change. We reserve the right to adjust pricing for future purchases. Existing purchases are honored at the price paid.
7. Your Profile & Usage Limits
Your learner profile powers the personalization features of the platform. By completing your profile, you agree that the information you provide may be used to generate personalized content tailored to your role and workflows.
- Profile updates are limited to 5 edits. This limit exists to maintain the integrity of personalized content that has already been generated based on your profile. If you need additional updates, contact support.
- Profile content must be accurate and relevant to your professional work. Profiles containing abusive, vulgar, or intentionally misleading content may be flagged or removed.
- AI-generated content. Personalized content on this platform is generated using third-party AI services, which may include providers such as Anthropic (Claude), OpenAI, and Google. When you complete your profile and purchase a personalization unlock, the information you provide (your first name, role, workflows, friction points, and other profile inputs) is sent to these AI services to generate tailored content for you. If you include company or organizational details in your profile fields, that information will also be processed by these AI services. We do not send your email address or last name to AI providers. All AI providers we use are configured to not train on your data. We may change AI providers at any time without notice, provided the same data protections are maintained.
- We do not share your individual profile data outside the platform except as described above for AI content generation. Your profile information is not sold, shared with other users, or used for advertising.
- AI-generated insights for managers. For team and organizational accounts, we may use AI services to analyze aggregated team submissions and activity in order to generate insights, patterns, and recommendations visible on the manager dashboard (such as opportunity signals, common themes, and suggested discussion topics). This analysis is performed on team-level data within your organization only. Individual submissions are not shared outside your organization as part of this process. The same data protections described above apply to all AI processing.
8. Account Access
You are responsible for maintaining the security of your account. Do not share your magic link or login credentials with others. Each account is tied to an individual user within an organization. The platform is intended for professional use by individuals aged 18 or older. By creating an account, you represent that you are at least 18 years of age.
9. Modifications
We may update or revise these Terms at any time. For material changes, we will make reasonable efforts to notify you via email or a notice on the platform before the changes take effect. Continued use of the platform after changes are posted constitutes acceptance of the new terms.
10. Limitation of Liability
Our training and resources are provided for educational and informational purposes only. We do not guarantee specific business outcomes, performance results, or financial gains.
To the fullest extent permitted by law, Moonswell Marketing LLC and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use or inability to use our platform or materials — even if we have been advised of the possibility of such damages. Your use of our services is at your sole risk.
11. Content & Communications Disclaimer
The content published on our platform, newsletter, or any affiliated channels is provided for general informational purposes only. It should not be considered professional, legal, or financial advice. We make no representations or warranties about the accuracy, completeness, or reliability of any information shared through our content. You assume full responsibility for any actions you take based on information from Chasing Next or Moonswell Marketing LLC.
12. Email Communications
By creating an account, you agree to receive account-related emails necessary for the service to function, including login links, invitations, and security notices. These emails cannot be opted out of.
We may also send product-related emails such as new module announcements, progress nudges from your manager, and milestone notifications. These are on by default and can be turned off in your email preferences at any time.
Marketing emails, including newsletters and blog updates, are only sent with your explicit consent. You can manage all email preferences from your account settings or by using the unsubscribe link included in every email.
13. Indemnification
You agree to indemnify, defend, and hold harmless Moonswell Marketing LLC, its officers, directors, employees, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to your use of the platform, your submissions, your violation of these Terms, or your violation of any rights of a third party.
14. Enterprise & Team Agreements
Team and organizational access to the platform may be governed by a separate Master Services Agreement (MSA), Statement of Work (SOW), or other written agreement executed between Moonswell Marketing LLC and the purchasing organization. In the event of a conflict between these Terms and an executed enterprise agreement, the enterprise agreement shall control for the scope of that engagement. All other provisions of these Terms remain in effect.
15. Acceptable Use & Account Termination
You agree to use the platform respectfully and in accordance with its intended purpose. The following are prohibited:
- Submitting abusive, harassing, discriminatory, or intentionally misleading content
- Attempting to access other users' or organizations' data
- Using the platform to develop competing products or services
- Interfering with the platform's operation, security, or other users' experience
- Sharing account access or magic links with unauthorized individuals
- Scraping, automating, or bulk-downloading platform content
We reserve the right to suspend or terminate accounts that violate these Terms or engage in prohibited conduct, with or without notice, at our sole discretion. If your account is terminated for a violation, purchases are non-refundable.
16. Data Retention
You may request account deletion at any time by contacting support@chasingnext.com. Upon deletion, your personal data will be removed within 30 days, except where retention is required by law or for legitimate business purposes (e.g., payment records, which are retained for up to 7 years for tax and accounting purposes).
For organizational accounts, data is retained for the duration of the engagement and a reasonable period afterward to support measurement, reporting, and follow-up engagements. Organizations may request data export or deletion at any time by contacting support.
17. Force Majeure
We are not liable for delays or failures in performance resulting from causes beyond our reasonable control, including but not limited to internet or infrastructure outages, third-party service disruptions, natural disasters, pandemics, or government actions.
18. Governing Law & Dispute Resolution
These terms are governed by the laws of the State of California, USA, without regard to conflict of law principles.
Any dispute arising from these Terms or your use of the platform shall first be attempted to be resolved through good-faith negotiation between the parties. If the dispute is not resolved within 30 days of written notice, it shall be settled by binding arbitration administered in accordance with the rules of JAMS, held in San Diego County, California. Each party shall bear its own costs unless the arbitrator determines otherwise.
You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. If this class action waiver is found to be unenforceable, then the entirety of this arbitration provision shall be null and void.
